TERMS OF SERVICE AGREEMENT
Root Causes Medicine Community
This Terms of Service Agreement (“Agreement”) governs your access to and participation in the Root Causes Medicine Community (the “Community”), an online membership platform operated by Root Causes Medicine, LLC (“RCM,” “we,” “us,” or “our”). By creating an account, subscribing to a paid membership, or otherwise accessing the Community, you (“you” or “Member”) agree to be bound by this Agreement.
Please read this Agreement carefully. It describes the nature of the Community, what we provide, what we do not provide, and the rules that apply to your participation. If you do not agree with any part of this Agreement, do not use the Community.
1. Nature of the Community
1.1 Educational and Editorial Purpose
The Community is a private, subscription-based educational and editorial platform organized around topics in functional medicine, integrative health, and wellness. It is designed to provide Members with curated written content, recorded and live group discussions, and a forum for community dialogue among Members interested in these subjects.
1.2 No Doctor-Patient Relationship
The Community does not provide medical care, medical advice, diagnosis, treatment, or any other clinical service. Nothing within the Community – including written content, live or recorded Q&A sessions, comment threads, member discussions, or communications with Derek Guillory, M.D. (“Dr. Guillory”) or any other contributor – creates a doctor
patient, provider-patient, or professional-client relationship between you and Dr. Guillory, any other contributor, or RCM.
Dr. Guillory and other credentialed contributors participate in the Community in their capacity as educators and authors, not as your treating physicians. Their participation is analogous to that of a physician-author appearing in a podcast, interview, book, or public lecture: they share perspectives, frameworks, and general information at a population or conceptual level. They do not review your individual medical history, evaluate your symptoms, recommend treatments specific to you, or respond to your circumstances as your physician. If a question posed within the Community veers into territory requiring individualized clinical judgment, the responding contributor will redirect you to your own care team.
1.3 Member Responsibility for Medical Care
You are responsible for your own medical care. Always consult a qualified, licensed healthcare provider for any questions concerning your individual health, symptoms, diagnosis, or treatment. Never disregard professional medical advice, or delay seeking it, because of something you have read, heard, or discussed within the Community. If you believe you are experiencing a medical emergency, contact emergency services immediately.
1.4 Content Authorship and Editorial Voice
Written content published within the Community reflects Dr. Guillory’s curated perspective and editorial voice. Some written content is prepared with the assistance of editorial and writing professionals working under Dr. Guillory’s direction, reviewed and approved by Dr. Guillory or his designated editorial team prior to publication. Live sessions hosted by Dr. Guillory feature his direct, unmediated participation.
2. Membership and Account
2.1 Eligibility
You must be at least eighteen (18) years old and capable of forming a binding contract to become a Member. By creating an account, you represent that you meet these requirements and that the information you provide is accurate and complete.
2.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify RCM promptly of any unauthorized access to or use of your account.
2.3 Subscription, Fees, and Renewal
Paid memberships are offered on a recurring monthly or annual basis at the rates published at the point of purchase. Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings, and cancellation will take effect at the end of the then-current billing period.
2.4 Refunds
Except where required by law, subscription fees are non-refundable once a billing period has begun. If you believe you have been charged in error or have a billing dispute, contact us at the address provided in Section 11 and we will work in good faith to resolve the matter.
2.5 Complimentary Access
RCM may, in its discretion, provide complimentary or promotional access to the Community in connection with the purchase of Dr. Guillory’s book, film, or other products. Complimentary access is subject to this Agreement and may be modified or discontinued at RCM’s discretion, except that complimentary access bundled with a specific product purchase will not be revoked during any promised access period absent a Member’s breach of this Agreement.
3. Member Conduct
3.1 General Standards
The Community is a space for thoughtful, respectful exchange. You agree to engage with other Members, contributors, and RCM staff in a manner that supports that purpose. You agree not to:
(a) Harass, threaten, or demean other Members, contributors, or staff;
(b) Post content that is defamatory, unlawful, obscene, or that infringes the rights of others;
(c) Use the Community to solicit or promote unrelated commercial products or services;
(d) Impersonate any person or misrepresent your affiliation with any person or entity;
(e) Attempt to access the Community by any means other than the interface provided, or otherwise interfere with the operation of the Community.
3.2 Medical Information Shared by Members
If you share personal medical or health information within the Community, you do so voluntarily and at your own discretion. RCM, Dr. Guillory, and other contributors are not your treating providers and will not respond to such information as your physician. You acknowledge that other Members may see what you share and that the Community is not a confidential medical setting. Do not share information you would not be comfortable making known to other Members.
3.3 Recordings and Redistribution
Live Q&A sessions and other live programming may be recorded by RCM and made available within the Community archive. Members may not redistribute, publish, post publicly, sell, or otherwise commercially exploit any recording, transcript, or other content from the Community without RCM’s prior written consent. Personal note-taking and personal-use copies are permitted. This restriction is intended to protect the privacy of other Members who participate in live sessions and the editorial value of Community content; it is not intended to restrict your ability to discuss what you have learned or to communicate with regulators, healthcare providers, legal counsel, or other appropriate parties about your own experience.
3.4 Consequences of Violation
RCM reserves the right to suspend or terminate the account of any Member who materially violates this Section 3, with or without notice depending on the severity of the conduct. Where reasonably practicable, RCM will provide notice and an opportunity to cure before terminating an account for non-egregious conduct. Termination for cause does not entitle the Member to a refund of fees previously paid.
4. Intellectual Property
4.1 Community Content
All content published by RCM, Dr. Guillory, or other contributors within the Community – including articles, recordings, transcripts, frameworks, illustrations, and other materials – is the property of RCM or its licensors and is protected by copyright and other intellectual property laws. Your membership grants you a personal, non-transferable, non-exclusive license to access and use Community content for your own personal, non-commercial educational purposes.
4.2 Member Contributions
When you post comments, questions, or other content within the Community (“Member Contributions”), you retain ownership of your contributions. You grant RCM a worldwide, royalty-free, non-exclusive license to host, display, reproduce, and distribute your Member
Contributions within the Community and, in de-identified or aggregated form, to develop and improve Community content and programming.
4.3 Use of Member Stories or Outcomes
If RCM wishes to use a Member’s identifiable story, testimonial, or health outcome in marketing or promotional materials, RCM will obtain that Member’s written consent before doing so and will provide appropriate disclosures consistent with Federal Trade Commission guidance on endorsements and testimonials. Submitting a comment or question within the Community does not constitute consent for marketing use.
5. Privacy
RCM’s collection and use of personal information is described in our Privacy Policy, which is incorporated into this Agreement by reference. You acknowledge that information you choose to share within the Community – including in comments, questions, and live sessions – may be visible to other Members and is not protected by physician-patient confidentiality, as no such relationship exists. RCM will handle personal information you provide to us (as distinct from information you publicly share within the Community) in accordance with the Privacy Policy.
6. Disclaimers
6.1 No Medical Advice
AS STATED IN SECTION 1, THE COMMUNITY DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. CONTENT IS PROVIDED FOR EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY. RELIANCE ON CONTENT WITHIN THE COMMUNITY IS AT YOUR OWN RISK.
6.2 “As Is” Provision of Services
THE COMMUNITY AND ALL CONTENT WITHIN IT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, RCM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. RCM DOES NOT WARRANT THAT THE COMMUNITY WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR OUTCOME WILL RESULT FROM PARTICIPATION.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, RCM, ITS OFFICERS, EMPLOYEES, CONTRIBUTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE COMMUNITY, EVEN IF RCM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ALL EVENTS, RCM’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THIS AGREEMENT OR YOUR USE OF THE COMMUNITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO RCM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY OR (B) ONE HUNDRED DOLLARS ($100).
Nothing in this Agreement limits liability for conduct that cannot be limited under applicable law, including gross negligence, willful misconduct, or fraud.
8. Indemnification
You agree to indemnify and hold harmless RCM, its officers, employees, contributors, and affiliates from any third-party claims, damages, or expenses (including reasonable attorneys’ fees) arising from (a) your material breach of this Agreement, (b) your violation of applicable law in connection with your use of the Community, or (c) your infringement of any third party’s rights through Member Contributions you post within the Community. This indemnification obligation does not apply to claims arising from RCM’s own conduct.
9. Dispute Resolution
9.1 Informal Resolution
If you have a concern or dispute with RCM, you agree to first contact us at the address in Section 11 and to attempt in good faith to resolve the matter informally for a period of at least thirty (30) days before initiating any formal proceeding.
9.2 Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to this Agreement or the Community that is not resolved through informal discussion shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall be conducted in Bexar County, Texas, or by remote means as the arbitrator may permit. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
9.3 Exceptions to Arbitration
Notwithstanding Section 9.2, either party may bring an individual action in small-claims court for disputes within that court’s jurisdiction. Nothing in this Agreement prevents you from reporting concerns to, or cooperating with, any governmental, regulatory, or law enforcement authority.
9.4 No Class Actions
Disputes shall be brought only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. If this provision is found unenforceable as to any particular claim, that claim shall be severed and adjudicated in court, while all other claims remain subject to arbitration.
9.5 Governing Law
This Agreement is governed by the laws of the State of Texas, without regard to its conflict of-laws principles, except that the Federal Arbitration Act governs the interpretation and enforcement of Section 9.2.
10. Modifications and Termination
10.1 Changes to This Agreement
RCM may modify this Agreement from time to time. Material changes will be communicated to Members by email or by prominent notice within the Community at least thirty (30) days before they take effect. Your continued use of the Community after the effective date constitutes acceptance of the modified Agreement. If you do not agree to a modification, you may cancel your membership before the effective date.
10.2 Termination by Member
You may terminate your membership at any time as described in Section 2.3.
10.3 Termination by RCM
RCM may suspend or terminate your access to the Community for material breach of this Agreement as described in Section 3.4, or for any other reason on reasonable notice. If RCM terminates your membership other than for cause, RCM will refund the pro-rated unused portion of your then-current subscription period.
11. General Provisions
11.1 Entire Agreement
This Agreement, together with the Privacy Policy and any other policies expressly incorporated by reference, constitutes the entire agreement between you and RCM concerning the Community and supersedes any prior agreements on the same subject.
11.2 Severability
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid or unenforceable provision shall be construed to give effect to the parties’ intent to the maximum extent permitted by law.
11.3 No Waiver
RCM’s failure to enforce any provision of this Agreement does not waive its right to do so later.
11.4 Assignment
You may not assign this Agreement without RCM’s prior written consent. RCM may assign this Agreement in connection with a merger, acquisition, or sale of assets.

11.6 Acknowledgment
By creating an account or subscribing to the Community, you acknowledge that you have read and understood this Agreement, including the sections describing the educational nature of the Community, the absence of any doctor-patient relationship, the arbitration provision in Section 9, and the limitations of liability in Section 7, and that you agree to be bound by its terms.
